TERMS OF SERVICE

1. Agreement to Terms

By purchasing, accessing, or using any services provided by ByteNode ("ByteNode", "we", "us", or "our"), you ("Customer", "User", or "Client") agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use our services.

2. Eligibility

You must be at least sixteen (16) years of age to use our services. By creating an account or purchasing services, you represent and warrant that you meet this age requirement.

3. Services

ByteNode provides hosting-related services including but not limited to:

• Virtual private servers (VPS)(Unmanaged)

• Dedicated servers

• Infrastructure hosting

• Related network and hosting services

Service specifications, availability, and pricing may change at any time without prior notice.

4. Acceptable Use

Users may not use ByteNode services for illegal, abusive, or malicious activities. Prohibited activities include but are not limited to:

• Distributed Denial of Service (DDoS) attacks

• Botnet operation or command-and-control systems

• Malware distribution

• Phishing, fraud, or scams

• Unauthorized network intrusion or hacking

• Hosting or distributing malicious software

• Spam or bulk unsolicited communications

• Any activity that violates applicable local, state, federal, or international law

Any activity deemed malicious, abusive, or harmful to our infrastructure, network, or other customers is strictly prohibited.

5. Fair Use Policy

All services are subject to a Fair Use Policy to maintain stable performance for all customers. Excessive or abnormal consumption of system resources including CPU, memory, disk I/O, bandwidth, or network capacity may result in service limitations, suspension, or required upgrades.

6. Suspension and Termination

ByteNode reserves the right to suspend, restrict, or terminate services immediately and without prior notice if:

• A violation of these Terms occurs

• Abuse or suspicious activity is detected

• Malicious or illegal activity is suspected

• Service usage threatens infrastructure stability or security

• Payment obligations are not met

Services may be temporarily suspended while investigating suspected abuse.

7. Customer Responsibilities

Customers are responsible for:

• Securing their account credentials

• Maintaining backups of their data

• All activity originating from their account

• Proper configuration and management of hosted services

• Compliance with all applicable laws and regulations

Customers remain fully responsible for any data, content, or services hosted on ByteNode infrastructure.

8. Data Loss Responsibility

ByteNode takes reasonable measures to maintain the stability and integrity of our infrastructure.

If data loss occurs directly due to failure, negligence, or operational error on ByteNode infrastructure, we accept responsibility and will make reasonable efforts to restore affected data where backups or recovery methods exist.

However, ByteNode is not responsible for data loss resulting from:

• User misconfiguration

• User deletion or modification of files

• Software installed by the customer

• Security breaches caused by weak credentials

• Third-party software failures

• Failure of the customer to maintain backups

Customers are strongly encouraged to maintain independent backups of all important data.

9. Support Scope

ByteNode provides reasonable technical support to ensure services are provisioned and functioning as intended.

Included support services include:

• Server provisioning assistance

• Basic troubleshooting for service availability

• Assistance with connectivity issues

• Basic infrastructure-related support

Support does not include:

• Full server management

• Application configuration or development support

• Advanced software troubleshooting

• Custom system administration

Additional support may be provided at our discretion.

10. Payments and Billing

All services must be paid in advance unless otherwise agreed.

Failure to make payment may result in:

• Service suspension

• Service termination

• Data deletion after account closure

Pricing may change with reasonable notice.

11. Service Availability

While ByteNode strives to maintain reliable uptime, uninterrupted service cannot be guaranteed. Maintenance, upgrades, hardware failures, and network events may cause temporary interruptions.

12. Limitation of Liability

To the fullest extent permitted by law, ByteNode shall not be liable for any indirect, incidental, special, or consequential damages including but not limited to:

• Loss of data

• Loss of profits

• Business interruption

• Service downtime

• Security incidents caused by user misconfiguration

Total liability for any claim shall not exceed the amount paid by the customer for the affected service during the previous billing period.

13. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, United States.

Any disputes arising under these Terms shall be resolved within the jurisdiction of Pennsylvania courts.

14. Modifications

ByteNode reserves the right to modify these Terms of Service at any time. Continued use of services following any updates constitutes acceptance of the revised Terms.
